Terms of Service


Introduction

Welcome to Dcoder! Our mission is to provide our user with a hosted environment to practice coding or to build and deploy software and web servers, made available through our Service. These Terms of Service (“Terms”) cover your use of and access to our services, client software and websites ("Services"). Our Privacy Policy explains how we collect and use your information while our Acceptable Use Policy outlines your responsibilities when using our Services. By using our Services, you’re agreeing to be bound by these Terms, our Privacy Policy.


Your Information or Content & Your Permissions

When you use our Services, you provide us with things like your files, emails, messages, contacts and so on (“Your Information”). Your information is yours. These Terms won't give us any rights to Your Information except for the limited rights that enable us to offer the Services.

We take no responsibility and except where prohibited by law, assume no liability for your information or content you or any third party posts on or through the Service. However, by posting this content using the Service you grant us the non-exclusive, worldwide, royalty-free, fully paid-up, sublicensable and transferable right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service. You agree that this license includes the right for us to make your content available to other users of the Service, who may also use your content subject to these Terms.

Also, you ensure the posting of your information or content on or through the service, does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright or any other intellectual property right. Additionally content that is deemed inappropriate, can be malicious, religion based hate, sexual and others and we can remove that without prior notice.

We need your permission to do things like hosting your information or content, backing it up and sharing it when you ask us to. Since our services also provide you with features such as commenting, sharing, searching, image thumbnails, codes, previews, posting, linking, storing, liking and otherwise making available certain information, text, graphics, videos, or other material and personalisation to aid you in your workflow or learning. Because part of the Service includes freeform text boxes for purposes of uploading your content, you fully control type and nature of this content, and as such you (and not Dcoder) are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness. In particular, to the extent you elect to upload content that includes Personal Information (as that term is defined in our Privacy Policy), you acknowledge and agree that, that content will be subject to our Privacy Policy, which is incorporated by reference into these Terms.

According to these features, Dcoder accesses, stores and scans Your Information and you give us permission to do those things, and this permission extends to our affiliates and trusted third parties we work with.

We also have the right but not the obligation to monitor and edit all your content provided, where necessary to comply with applicable law or to ensure the consistency, security, and stability of our Services. With the Exception provided in the “Open Source and User Content” section below, you will comply with our Acceptable Use of Our Service (Acceptable Use Policy).


Open Source and Your Content

We love Open Source and stand by it’s ethos. We want to ensure we maintain its faith and structure going forwards, that’s why, by posting content on certain portions of the Services or through certain features or functionalities, such content may be automatically subject to an open source license. Additional terms and conditions related to open source licensing on the Services can be found at this link, https://opensource.org/licenses/GPL-3.0, and such terms and conditions are hereby incorporated into this Agreement by reference.


Acceptable Use of Our Service (Acceptable Use Policy)

Except to the extent permitted by applicable law, you agree not to distribute, sell, translate, reproduce, reverse engineer or reverse compile or decompile, disassemble or make derivative works of, in any medium, any part of the Service or Dcoder’s content or code without Dcoder’s authorization, unless Dcoder makes available the means for such distribution through functionality offered by the Service.

You agree not to alter or modify any part of the Service.

You agree to not use the Service to attack or tamper with other websites, services, and individuals. Any such activity gives us the right to ban the account and take necessary actions against the account holder.

You agree not to use the Service for any of the following commercial uses unless you obtain Dcoder’s prior, written approval:

The sale of access to the Service;

The sale of advertising, sponsorships, or promotions placed on or within the Service or Dcoder’s content; or

The sale or advertising, sponsorships, or promotions on any page of an ad-enabled blog or website containing content delivered via the Service, unless other material not obtained from Dcoder appears on the same page and is of sufficient value to be the basis of such sales.

Prohibited commercial uses do not include any use that Dcoder expressly authorizes in writing.

You agree not to interfere with or take action that results in any interference with or distribution of the Service or networks connected to the Service. You agree not to attempt to gain unauthorized access to other computer systems or networks connected to the Service. Dcoder reserves all other rights. Except as expressly provided herein, nothing as a part of the Service will be construed as conferring any license under Dcoder’s and/or any third party’s intellectual property rights.

You agree not use or launch any automated system, including without limitation, “robots”, “spiders”, or “offline readers” that access the Service in a manner that sends more request messages to the Dcoder servers in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser. Notwithstanding the foregoing, Dcoder may grant the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Dcoder reserves the right to revoke these exceptions either generically or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the Service, nor to use the communication systems provided by the Services for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Service with respect to their content.

You will comply with all applicable laws in your use of the Service.

You agree not to use the Service for any illegal or fraudulent purposes.

You agree not to use the Service for any resource-intensive activities related to cryptocurrency, such as mining.

You agree and acknowledge that Dcoder reserves the right to discontinue or revoke any of the foregoing rights and/or your access to the Service, or any aspect of the Service, at any time and without prior notice.


Our Stuff

The Services are protected by copyright, trademark, and other US and foreign laws. These Terms don’t grant you any right, title or interest in the Services, others’ content in the Services, Dcoder trademarks, logos and other brand features. We welcome feedback but please note that we may use comments or suggestions without any obligation to you.


Linking to our content

The following organizations may link to our Web site without prior written approval:

  • Government agencies
  • Search engines
  • News organizations
  • Online directory distributors when they list us in the directory may link to our Web site in the same manner as they hyperlink to the Web sites of other listed businesses.
  • Review blogs/forums

These organizations may link to our app, and/or our respective products homepage, to publications or to other Web site information so long as the link: (a) is not in any way misleading; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site. We may consider and approve in our sole discretion other link requests from the following types of organizations:

commonly-known consumer and/or business information sources such as Chambers of Commerce, American Automobile Association, AARP and Consumers Union; dot.com community sites; associations or other groups representing charities, including charity giving sites, online directory distributors; internet portals; accounting, law and consulting firms whose primary clients are businesses; and educational institutions and trade associations. We will approve link requests from these organizations if we determine that: (a) the link would not reflect unfavorably on us or our accredited businesses (for example, trade associations or other organizations representing inherently suspect types of business, such as work-at-home opportunities, shall not be allowed to link); (b)the organization does not have an unsatisfactory record with us; (c) the benefit to us from the visibility associated with the hyperlink outweighs the absence of Dcoder; and (d) where the link is in the context of general resource information or is otherwise consistent with editorial content in a newsletter or similar product furthering the mission of the organization.

We employ the use of cookies. By using Dcoder website/apps you consent to the use of cookies in accordance with Dcoder's privacy policy.

Most of the modern day interactive websites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies.

Without prior approval and express written permission, you may not create frames around our Web pages/app content or use other techniques that alter in any way the visual presentation or appearance of our App/web site.

You acknowledge and agree that Dcoder cannot and will not review, censor, endorse or edit the content of any third party site, services or advertisements. Where the Service contains links to such third party websites, services or advertisements, these links are provided for your information and convenience only. You acknowledge and agree that your use of any third party websites, services and/or advertisements is at your own risk and that you should apply a suitable level of caution and discretion in accessing any such third party links. When you click on any third party links, the applicable third party’s terms and policies apply, not these Terms. To the fullest extent permitted by law, by using the Service, you expressly relieve Dcoder from any and all liability arising from your use of any third party website, services or advertisements and/or from your use of or access to any third party content made available through the Service, including without limitation, any User Content made available or accessed through your interactions with other users of the Service.

You acknowledge and agree that to the fullest extent permitted by law, Dcoder shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.


Availability, Errors and Inaccuracies

We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.

We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

By creating an Account on our Service, you agree that, from time to time, we may contact you to notify you about certain changes or additions to the Service or regarding your use of the Service. Accounts; Account Termination Policy

When you create an account with us, you guarantee that you are above the age of 13, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

Dcoder may terminate a user’s access to the Service if the user is determined to be a repeat infringer or in Dcoder’s sole discretion, Dcoder determines that a user has breached or otherwise violated these Terms. If Dcoder, in its sole discretion, determines that your User Content violates these Terms for any reason, Dcoder may at any time, without prior notice and in its sole discretion, remove such User Content and/or terminate a user’s account. In addition to the foregoing, we reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.


Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that User Content posted on the Service infringes on the copyright or other intellectual property rights ("Infringement") of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to [email protected], with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged Infringement as detailed below, under "DMCA Notice and Procedure for Copyright Infringement Claims"

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any User Content found on and/or through the Service on your copyright.


Indemnification

You agree to defend, indemnify and hold harmless Paprbit, Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Dcoder and its licensee and licensors, and their employees, contractors, agents, officers and directors and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) your breach or violation of these Terms, c) User Content posted on the Service and/or d) your violation of any law or regulation.


Limitation Of Liability

In no event shall Dcoder, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. Dcoder’s total, cumulative liability for any claim, loss or damage arising out of or relating to these terms shall be max ten dollars ($10.00 USD) for paid users.

NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE OUR LIABILITY FOR: (X) DEATH OR PERSONAL INJURY RESULTING FROM OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS OR SUBCONTRACTORS; (Y) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (Z) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED BY APPLICABLE LAW.


Warranty Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Paprbit, Inc. its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, be error-free, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; d) the results of using the Service will meet your requirements; or (d) that the Service and/or any content made available through the Service will be accurate or complete.

Dcoder assumes no liability or responsibility for any errors, mistakes or inaccuracies of content, any personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Service, any unauthorized access to or use of our Service, any interruption or cessation of transmission to or from the Service, any bugs, viruses, Trojan horses or the like which may be transmitted to or through our Service by any third party and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of the Service and/or any content posted, emailed, transmitted or otherwise made available via the Service.

Some jurisdictions do not allow for limited liability or exclusion of implied warranties, so not all of the above limitations and/or warranty disclaimers may apply to you. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.


Ability to Accept Terms (No Users Under 13)

You must be at least age 13 or older to create an Account or use the Services. Dcoder does not target our Services to users under the age of 13 and we do not permit any users under the age of 13 to use your Service. If we learn of any user that is under the age of 13, we will immediately terminate the user’s Account and delete any and all information we may have about that user (unless otherwise required by applicable law). Assignment & changes

These Terms and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be freely assigned by Dcoder without restriction.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
